A BILL to amend article ten, chapter eighteen-b of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
seven-a, relating to tuition deferments for striking coal
miners and their dependents.
Be it enacted by the Legislature of West Virginia:
That article ten, chapter eighteen-b of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
seven-a, to read as follows:
ARTICLE 10. FEES AND OTHER MONEY COLLECTED AT STATE
INSTITUTIONS OF HIGHER EDUCATION.
§18B-10-7a. Tuition deferments for striking coal miners, and
spouses and children of striking coal miners.
Each state institution of higher education shall allow a
deferment for tuition for each person employed in the coal mining
industry who is not so employed due to an authorized strikecalled by the united mine workers of America. The spouse and
children of a person employed in the coal mining industry who is
not so employed due to an authorized strike called by the united
mine workers of America are also allowed a deferment for tuition.
The deferment for tuition will expire, for all persons eligible,
upon the eligibility to return to full employment of the striking
person.
Each state institution of higher education, as a condition
of granting the tuition deferment described in this section,
shall verify through offices of the united mine workers of
America that the person seeking the deferment, whether for
himself or herself or for a spouse or his or her children, is
employed in the coal mining industry and that an authorized
strike is in progress which has resulted in the unemployment of
that person.
NOTE: The purpose of this bill is to allow a higher
education deferment for tuition for striking coal miners and
their dependents.
